Leo Merriweather, Jr., the appellant, was indicted in separate indictments and convicted for murder made capital because it was committed during a burglary in the second degree, in violation of Ala. Code 1975, Â§ 13A-5-40(a)(4), and murder made capital because it was committed during a robbery in the first degree, in violation of Â§ 13A-5-40(a)(2). The trial court followed the jurys recommendation and sentenced the appellant to life imprisonment without the possibility of parole. The appellant raises three issues on this direct appeal from that conviction.
